The short version, which is not the legal version but is honest: Warmline writes the first line of a cold outreach message. It is free, there is no account, and nothing you type into the prospect fields is stored on our servers. You own what you send. You are responsible for who you send it to and for following the outreach laws that apply to you. The full terms below are what actually govern your use.
Warmline is a web tool operated by data according to me ("Warmline", "we", "us", "our") at warmline.dataaccordingtome.com and any subdomain or successor address we use for it.
These Terms of Service ("Terms") are a binding agreement between you and us. They cover the website, the opener generator, the API endpoints that power it, the newsletter signup, the notes box, and every other feature we make available at that address (together, the "Service").
By loading the site, generating a line, submitting an email address, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.
These Terms incorporate our Privacy Policy and, where you use Warmline in the course of a business that involves personal data of other people, our Data Processing Addendum. Read all three.
You must be at least 16 years old to use the Service. If you are between 16 and the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
If you use the Service on behalf of a company, partnership or other organisation, you confirm that you have authority to bind that organisation to these Terms, and "you" means both you and that organisation.
You may not use the Service if you are located in, or are a national of, a country subject to a United States government embargo, or if you appear on any United States government list of prohibited or restricted parties.
Warmline takes a small amount of information you supply about a person you want to contact (a name, a company or newsletter, one researched detail, an optional note about why you are reaching out, and a chosen tone) and returns a two to four sentence opening line written in a human voice.
Warmline is a writing aid. It is not any of the following:
The Service is currently offered free of charge and without an account. A free allowance of fifteen (15) generated lines per browser is tracked locally in your browser's storage. Clearing that storage resets the local counter, and we do not treat that as a breach of these Terms on its own.
Separately, we apply server-side rate limits to protect the Service and to keep our costs survivable. Those limits currently include a per-IP daily cap and a global daily cap across all visitors. When a cap is reached you will see a message saying so. Reaching a rate limit is normal operation, not a fault.
We may change, raise, lower or remove any of these limits at any time, with or without notice. We may also introduce paid plans. If we do, the paid terms in section 17 apply to those plans, and we will not retroactively charge you for use of the free tier.
You must not attempt to evade a rate limit, whether by rotating IP addresses, scripting requests, using proxies or VPN rotation for that purpose, or by any other means. Doing so is a material breach of these Terms.
"Input" means anything you type into the Service, including prospect names, company or newsletter names, the researched detail, the outreach reason, your email address if you subscribe, and any note you leave in the notes box.
You keep ownership of your Input. You grant us a limited, non-exclusive, worldwide, royalty-free licence to process your Input for the sole purpose of operating the Service and returning a result to you.
Prospect Input (name, company, detail, outreach reason and tone) is transmitted to our AI model provider to generate your line and is not written to any database we control. We do not build a profile of the people you name, we do not sell that information, and we do not use your Input to train any model. The detail of what is stored, for how long, and by whom, is set out in the Privacy Policy.
You are responsible for what you put in. Do not paste sensitive personal data into Warmline. In particular, do not enter government identifiers, financial account numbers, health information, biometric data, precise location data, information about a person's race, religion, political opinions, trade union membership, sex life or sexual orientation, or any information about a child. Do not enter anyone's confidential or trade secret information, or anything you are under a duty not to disclose.
You warrant that you have the right to submit every piece of Input you submit, and that submitting it does not breach any contract, confidentiality obligation, privacy law or third party right.
"Output" means the line the Service returns to you.
As between you and us, you own the Output. We assign to you whatever rights we may have in the Output for your specific request, and you may use it commercially, edit it, publish it, and send it, without attribution and without paying us.
Two honest caveats you should understand:

We may investigate suspected breaches and may suspend or block access, remove content, and cooperate with law enforcement where we reasonably believe it is necessary.
This is the section people skip and then regret. Warmline writes a line. Everything about whether you are allowed to send that line to that person is on you.
When you send outreach written with the Service, you are the sender. You alone are responsible for complying with the law that applies to that message, which may include:
We give no advice on any of this and we do not review your outreach. If you are unsure whether you may contact someone, get advice before you send.
Output is produced by a large language model. Language models produce fluent text that can be wrong. Output may contain statements about a person or company that are inaccurate, outdated, or entirely invented, including where your Input was accurate.
You must read every line before you send it. Treat Output as a draft written by an assistant who has never met the recipient, because that is what it is.
We make no promise about reply rates, open rates, meetings booked, deals closed, offers received, or any other outcome. Any figures, testimonials or example lines shown on the site are illustrative and are not a representation of results you will get.
We apply filters intended to remove certain phrasing and punctuation patterns. Those filters are best-effort. They will sometimes miss, and their operation is not a warranty about the character or quality of any line.
The Service depends on third parties, including our hosting provider, our AI model provider and our key-value storage provider. Their availability, changes and outages affect the Service and are outside our control.
The site links to third party destinations including Substack, Gumroad, GitHub, LinkedIn, Upwork and Buy Me a Coffee. We do not control those sites, we are not responsible for their content or practices, and your use of them is governed by their own terms and privacy policies.
The Service, including its design, copy, illustrations, brand, name, logo and the arrangement of its code, is owned by us or our licensors and is protected by intellectual property law. Where we choose to publish any part of the source code under an open source licence, that licence governs your use of that part, and the licence text will accompany it. Nothing in these Terms grants you any right to the Warmline name, logo or brand.
Except as those licences allow, you may not copy, modify, distribute, sell, lease or create derivative works from the Service.
If you leave a note in the notes box, submit feedback, or suggest an improvement, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, display, adapt and publish it, including on the site, with the name you supplied.
Notes are held for review before anything is displayed. We may decline to publish, may edit for length, and may remove a published note at any time for any reason. Do not include personal data of third parties, confidential information, or anything you would not want shown publicly. If you want a note you submitted removed, email us and we will remove it.
You are not entitled to compensation for feedback, and we are free to implement it without obligation to you.
The Service is provided on an as-available basis. We do not commit to any uptime level. We may change, suspend, limit or discontinue the Service or any feature of it at any time, including the free tier, and we may do so without notice where we reasonably need to.
Because there is no account and nothing you type is stored, there is nothing for you to export or lose if the Service stops. Download anything you want to keep at the time you generate it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUTPUT WILL BE ACCURATE, ORIGINAL, SUITABLE FOR YOUR PURPOSE OR COMPLIANT WITH ANY LAW APPLICABLE TO YOU.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OPERATORS, CONTRACTORS OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OPPORTUNITY, DATA OR REPUTATION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
THIS INCLUDES, WITHOUT LIMITATION, LIABILITY ARISING FROM: OUTPUT THAT IS INACCURATE OR OFFENSIVE; A MESSAGE YOU SENT THAT DAMAGED A RELATIONSHIP; A REGULATORY PENALTY, INVESTIGATION OR COMPLAINT ARISING FROM OUTREACH YOU SENT; A PLATFORM SUSPENDING OR BANNING YOUR ACCOUNT; OR THE UNAVAILABILITY OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) FIFTY UNITED STATES DOLLARS (US$50). IF YOU HAVE PAID US NOTHING, WHICH IS THE CASE FOR THE FREE TIER, THAT CAP IS US$50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will defend, indemnify and hold harmless data according to me and its operators, contractors and suppliers from and against any claim, demand, proceeding, loss, liability, damage, penalty, cost or expense, including reasonable legal fees, arising out of or related to:
We will notify you of any claim we seek indemnity for and may participate in the defence with counsel of our choosing at our own cost. You may not settle any claim in a way that imposes an obligation or admission on us without our prior written consent.
The Service is free today. If we introduce a paid plan, the following applies to it from the moment you subscribe:
You may stop using the Service at any time. There is no account to close.
We may suspend or terminate your access immediately, without notice, if we reasonably believe you have breached these Terms, put the Service or another user at risk, or exposed us to legal liability. Where the breach is capable of cure and the risk is low, we will normally give you the chance to fix it first.
Sections 5, 6, 8, 9, 11, 12, 14, 15, 16, 19 and 21 survive termination.
These Terms and any dispute arising out of or related to them or to the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at amy@dataaccordingtome.com with a written description of the dispute and to negotiate in good faith for at least thirty (30) days. Most things are fixable in an email.
If the dispute is not resolved, you and we submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, and each of us waives any objection to venue there. You may also bring an individual claim in a small claims court that has jurisdiction over you.
Class action waiver. To the extent permitted by law, you and we each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding.
If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law gives you the right to bring proceedings in your local courts and to the protection of your local mandatory consumer law, nothing in this section removes that right.
We may update these Terms. When we do, we will change the "Last updated" date at the top of this page. If a change is material and adverse to you, we will make a reasonable effort to flag it on the site or by email if you are subscribed, before it takes effect.
Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service.
Entire agreement. These Terms, together with the Privacy Policy and the Data Processing Addendum, are the entire agreement between you and us about the Service and replace any prior understanding on that subject.
Severability. If any provision is held unenforceable, it is severed or narrowed to the minimum extent necessary and the remainder stays in force.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
No third party beneficiaries. Nobody other than you and us has any right to enforce these Terms.
Force majeure. Neither party is liable for a failure to perform caused by an event beyond its reasonable control, including outages at a third party provider, network failure, natural disaster, epidemic, war, civil unrest or government action.
Relationship. Nothing here creates a partnership, joint venture, employment or agency relationship between you and us.
Notices. We may give you notice on the site or by email if you have subscribed. You give us notice at the address in section 22.
Headings. Headings are for convenience and do not affect interpretation.
